GENERAL TERMS AND CONDITIONS
1. Introduction
These General Terms and Conditions (hereinafter: “Terms and Conditions”) regulate the
relationship between Montenegro Escape Tours, as tour operator tourist agency duly registered
and licensed in Montenegro, and the client who books or uses services provided by the Agency.

By purchasing travel package, you establish a legal relationship with Montenegro Escape Tours.
By signing the travel contract, you confirm that you are familiar with the program details and
conditions and that you fully accept them.
All information related to travel conditions constitutes a legal obligation between the travel
organizer and the customer (service user) and represents the sole basis for resolving any disputes
that may arise.
These General Terms and Conditions form an integral part of the travel agreement between the
traveler and the organizer, Montenegro Escape Tours, and are binding on both contractual parties.
By booking or using any service offered by the Agency, the Client confirms acceptance of these
Terms and Conditions.

2. Scope of Services
Montenegro Escape Tours operates as an incoming tour operator and provides tourist services
within Montenegro, including but not limited to:
• Organization of tour packages and tailor-made travel programs
• Accommodation arrangements
• Transfer and transportation services
• Excursions, activities, and guided tours
• Outdoor, cultural, and adventure experiences
The Agency provides services directly through contracted partners.

3. Booking and Contract Conclusion
A travel contract is considered concluded when:
• The Client submits a booking request (online, by email, or in writing),
• The Agency confirms availability and conditions, and
• Payment is made in accordance with the agreed terms.
All confirmed arrangements form an integral part of the travel contract.
By signing the Contract, the Client confirms acceptance of these Terms and Conditions and Travel
Program, as well as conditions of insurance.
The Agency is obliged to notify Client of any changes in written form.

4. Prices and Payments
4.1. All prices are expressed in EUR.
4.2. Prices include only services explicitly stated in the offer or booking confirmation.
4.3. Services not listed in the program are not included in the price.
4.4. The Agency reserves the right to modify prices due to changes in operating costs, taxes, or
supplier prices, in accordance with applicable law.
4.5. The Client is obliged to pay 40% of total amount upon signing the Contract and other 60%
before the start of the Travel Program.

5. Client Obligations
The Client is obliged to:
• Provide accurate personal and travel information
• Hold valid travel documents and visas
• Respect Montenegrin laws, customs, and safety rules
• Follow instructions of guides and service providers
The Agency is not responsible for damages resulting from non-compliance.

6. Agency Obligations
The Agency is obliged to:
• Act with due professional care,
• Provide the agreed services in accordance with the travel program,
• Inform passengers of relevant changes,
• Offer appropriate alternatives or refunds in case of non-performance, in accordance with
applicable law.

7. Changes and Cancellations by the Client
7.1. All cancellations must be submitted in writing.
7.2. Cancellation fees apply as follows (unless otherwise agreed):
• More than 30 days prior to service start – administrative costs
• 15–30 days – up to 30% of total price
• 8–14 days – up to 50% of total price
• 0–7 days or no-show – up to 100% of total price
7.3. Refunds are processed in accordance with supplier conditions.

8. Changes and Cancellations by the Agency
8.1. The Agency may cancel or modify services due to force majeure, safety concerns, or
operational reasons.
8.2. In such cases, the Client is entitled to a replacement service or a refund for unused services.

9. Travel Insurance and Travel Guarantee
9.1. Montenegro Escape Tours holds a valid Travel Guarantee Insurance Policy, in accordance
with Montenegrin tourism legislation.
92. This insurance covers:
• Insolvency of the Agency
• Repatriation of travelers, if applicable
• Refund of paid travel services in accordance with the policy terms
9.3. Clients are advised to obtain additional personal travel insurance (health, cancellation,
luggage).

10. Complaints and Claims
10.1. Any irregularity must be reported immediately during the service.
10.2. Written complaints must be submitted within 8 days after service completion.
10.3. The Agency shall respond within the legally prescribed period.

11. Liability
11.1. The Agency is responsible for the proper organization of services.
11.2. The Agency is not liable for:
• Services booked by Client through third-party providers
Any cancellations or changes related to services booked directly by the Client through thirdparty
providers (e.g., tours, activities, transport, tickets) are subject to the terms and conditions
of those third-party providers. Montenegro Escape Tours has no liability for refunds, fees, or
changes imposed by third-party providers.
• Loss or damage of personal belongings
• Injuries arising from activities undertaken at the Client’s own risk
• Force majeure events
11.3. Liability is limited in accordance with Montenegrin law.

12.1. During the provision of services, Clients are required to immediately report any issues or
irregularities to the Agency or its representative, in order to allow prompt resolution.
12.2. If a complaint cannot be resolved on the spot, the Client must submit a written complaint
by email or in writing within 8 days after completion of the service.
12.3. Montenegro Escape Tours shall review and respond to all complaints within the
timeframe prescribed by Montenegrin law.
13. Personal Data Protection
Personal data is processed in accordance with the Law on Personal Data Protection of
Montenegro and applicable GDPR standards.

14. Passport, Visa, and Health Requirements
The Client is solely responsible for compliance with travel document and health requirements.

15. Force Majeure
Neither party shall be held liable for non-performance caused by circumstances beyond
reasonable control.

16. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of Montenegro, with jurisdiction of the
competent court in Montenegro.

17. Final Provisions
17.1. These Terms and Conditions are publicly available on the Agency’s website and premises.
17.2. The Agency reserves the right to amend these Terms and Conditions.
17.3. These Terms and Conditions enter into force upon publication.
